Taxable Services for Expatriates

When expatriates work in India, their entire salary-related income is subject to tax, regardless of where the payment is made. This includes:

However, there are exceptions. Expenses incurred by an employer for relocating an expatriate to and from India and home-leave airfares are not considered taxable income. Additionally, retirement benefits paid in the expatriate’s home country are not subject to Indian tax laws.

Special Provisions for Foreigners

India offers several special concessions for expatriates:

1. Foreign Enterprise Employees: Remuneration received by a foreign national employed by a foreign enterprise is not subject to Indian income tax if:

  • The foreign enterprise is not engaged in trade or business in India.
  • The foreigner is not in India for more than 90 days in that financial year.
  • The remuneration is not deducted in computing the employer’s taxable income in India.

2. Special Tax Concessions: A foreigner who was not a resident in India for any of the four financial years preceding the year of arrival is eligible for a special tax concession if:

  • They possess specialized knowledge and experience in specific industries.
  • They are employed in a role that utilizes this specialized knowledge.

3. Visiting Foreign Professors: Foreign professors teaching in Indian universities or educational institutions are exempt from tax on their remuneration for the first 36 months, provided they were not residents in India during the preceding four financial years.

4. Employment on Foreign Ships: Salaries earned by non-resident foreigners working on foreign ships are exempt from tax if their stay in India during the year does not exceed 90 days.

5. Other Special Exemptions: Exemptions are available under specific circumstances, including:

  • Amounts received from a foreign government or body for research under an approved scheme.
  • Remuneration for foreign government employees during training with the Indian government.
  • Remuneration for non-resident expatriates involved in motion picture productions.

Statutory Deductions

Under the Income Tax Act 1961, every person responsible for paying salary must deduct income tax at the average rate based on the applicable rates for that financial year. This deduction is required even if the foreign national has multiple employers or successive employment.

Additional deductions from an expatriate’s income may include:

  • Recovery of advances or loans from any welfare fund.
  • Damage to or loss of goods entrusted for custody.
  • House accommodation provided by the employer.
  • Deductions required by court orders.
  • Subscriptions to and repayments from any provident fund.
